The “Best Interest of the Child Standard” in Texas

Texas refers to child custody as conservatorship and visitation as possession and access. In Texas, the court bases its decisions on conservatorship and possession and access to children on “the best interest of the child” standard.

This standard may be found in the Texas Family Code Section 153.002. When determining the best interest of the child, the court considers several factors.

These factors are from the Texas Supreme Court case Holley v. Adams and include but are not limited to:
